What if the person causing the injury is uninsured while using a car but not driving a car?  In an unpublished opinion, the Kansas Court of Appeals addressed the issue in Carrosco vs. Allstate. The case involved non-typical facts, it was an attempted carjacking. The plaintiff was in a truck when another person walks up with a gun and attempts to hijack the truck. The hijacker had a get-a-way car driven by a friend. In the altercation, the plaintiff gets shot in the leg. The hijacker spends off in the get-a-way car. The plaintiff makes an interesting claim against his uninsured motorist policy saying the person that caused the injury was uninsured. The Court decided against the plaintiff saying though the hi-jacker was uninsured, the policy required him to be operating a vehicle before the coverage comes into play.
