<p class="wp-block-paragraph">Taking unopposed estrogen with an intact uterus for a long time has been shown to increase the risk of endometrial cancer significantly. Endometrial hyperplasia, an overgrowth in the lining of the uterus, has been demonstrated in as many as 50% of women taking unopposed estrogen within one year (Martin &amp; Barbieri, 2019b). The risk of endometrial carcinoma for women taking unopposed estrogen is approximately 1 in 100; risk increases with time and continued use and persists even after discontinuation (Martin &amp; Barbieri, 2019b).  Long term use of hormone replacement therapy is also associated with an increased risk of cardiovascular events, including stroke (Martin &amp; Barbieri, 2019a,b). Taking estrogen unopposed means you’re taking it without also taking progesterone in conjunction with it. Using estrogen for the management of menopausal symptoms is appropriate in women with an intact uterus, but progesterone must also be provided (Martin &amp; Barbieri, 2019a,b). </p>

<h2 class="wp-block-heading"><strong>Is It Considered Medical Malpractice If I get Cancer After Taking Unopposed Estrogens?</strong></h2>

<p class="wp-block-paragraph">If a postmenopausal woman experiences bleeding, a doctor can investigate using ultrasound or biopsy to rule out the presence of endometrial cancer. An ultrasound is a useful assessment tool of the endometrial lining in postmenopausal women as clinicians have associated an endometrial thickness of greater than five millimeters with a higher risk for endometrial carcinoma. A physician can also use transvaginal as an additional tool for assessment (Feldman, 2019). While ultrasound is useful, endometrial sampling, or biopsy, is the gold standard to assess endometrial hyperplasia for carcinoma (Feldman, 2019).  </p>

<p class="wp-block-paragraph">Some patients can’t tolerate progesterone therapy. In such cases, when a physician has prescribed unopposed estrogen, the patient must be monitored closely with yearly endometrial biopsies. Vaginal bleeding in women receiving hormone therapy may require sampling of the endometrium to rule out hyperplasia.<strong>(</strong><a href="#_Hlk511284871"><strong>Ref &#8211; 1</strong></a><strong>)</strong></p>

<h2 class="wp-block-heading"><strong>Best Practices for Long Term Use of Hormone Replacement Therapy</strong></h2>
<p></p>
<p></p>
<p class="wp-block-paragraph">Before prescribing estrogen therapy to a post-menopausal woman, a physician must weigh the risks and benefits and inform their patient of these risks and benefits. Patients should receive regular clinical follow up to determine if the treatment is still necessary. The increased risk of endometrial cancer in postmenopausal women taking estrogens supplements depends on both the duration of treatment and the estrogen dose. A doctor should utilize the lowest dose that will control symptoms, and they should discontinue medication soon after prescription. Generally, hormone replacement therapy isn’t continued for more than five years. When prolonged treatment is medically indicated, the patient should be reassessed every six months, and the dosage should be adjusted based upon the patient&#8217;s response. If they present with abnormal vaginal bleeding, a physician should use adequate diagnostic measures to rule out endometrial carcinoma.<strong>(</strong><a href="#_Hlk511284895"><strong>Ref-2</strong></a><strong>)</strong></p>

<p class="wp-block-paragraph">The known decrease in ovarian androgen production rates and serum androgen concentrations has caused concern that menopause might be associated with a decline in libido. An age-associated reduction in sexual desire has been observed in both men and women. However, it is unclear whether the decrease in libido in women is age or menopause-related, since studies in women have not shown a significant correlation between libido and the serum estradiol or testosterone concentration [<a href="https://www.uptodate.com/contents/treatment-of-menopausal-symptoms-with-hormone-therapy/abstract/54">54</a>].</p>

<p class="wp-block-paragraph">Clinical trials of exogenous testosterone replacement suggest modest benefits of testosterone therapy in some postmenopausal women. However, there are potential risks associated with androgen replacement, and the use of testosterone is limited by the lack of approved and commercially available products for women. Until the beneficial effects of androgen replacement are better established, it cannot be routinely recommended to postmenopausal women. <p class="wp-block-paragraph">For women who choose estrogen or combined EPT, short-term use is suggested (generally not more than five years or not beyond age 60 years [<a href="https://www.uptodate.com/contents/treatment-of-menopausal-symptoms-with-hormone-therapy/abstract/28">28</a>]). However, hot flashes persist for an average of 7.4 years, and many women continue to have symptoms for more than ten years. Some women with persistent symptoms choose longer-term therapy. <p class="wp-block-paragraph">Systemic estrogen therapy without an opposing progestin in a woman with a uterus results in a markedly increased risk of endometrial hyperplasia or carcinoma.</p>

<p class="wp-block-paragraph">Endometrial hyperplasia has been demonstrated in 20 to 50 percent of women after one year of receiving systemic estrogen therapy without a progestin [<a href="https://www.uptodate.com/contents/endometrial-carcinoma-epidemiology-and-risk-factors/abstract/15-17">15-17</a>]. Multiple case-control and prospective studies have shown an increased incidence of endometrial carcinoma, with relative risk ranging from 1.1 to 15 [<a href="https://www.uptodate.com/contents/endometrial-carcinoma-epidemiology-and-risk-factors/abstract/18-20">18-20</a>]. The risk is related to both estrogen dose and duration of use.</p>

<p class="MsoNormal">Pain hurts.&nbsp; When my client comes into the office, I can see it in their eyes. As a personal injury lawyer, I often see my clients experience agony which will not go away with simple ibuprofen. Usually my clients have experienced a severe physical injury. It might be a broken arm or leg. Whether a sprained neck, herniated disc in the back, broken ribs, torn meniscus in the knee, head concussions, I have seen it all. I have looked into their eyes as they attempt to tell me about how pain cripples their lives. Their eyes tear me up inside as well. I can not make their pain go away or take away the emotional toll the chronic pain has taken.&nbsp; I am not a doctor. I am not a healer. I am a lawyer. As a lawyer, I have learned that walking alongside my clients through their chronic pain is essential to helping with their case.</p>
<p class="MsoNormal">Identifying with their pain makes me realize how wrong it is for them to suffer. I realize how wrong it is that another person was not careful. Our laws recognize the wrong too. Our law requires a measure of justice for two reasons. One it teaches the wrongdoer, and it also compensates the victim. The law has taught me to feel the pain.</p>
<p class="MsoNormal">This is why I empathize with their tears in my office and pound the table on their behalf in the courtroom.</p>

<p>Although the first Bariatric surgery was in the early 1950’s the number of Bariatric surgeries increased dramatically when it was decided to have Medicare and Medicaid pay for the Bariatric surgery. The first Bariatric surgery malpractice case was in the early 1980’s involving the death of a mother after overwhelming sepsis caused by an anastomotic leak, which still remains the most common complication.  Other complications include: Postoperative metabolic problems, Small bowel obstructions, Postoperative respiratory problems, Postoperative fluid overloads, Injury to other organs during surgery, Postoperative pulmonary embolism, Strictures at the operative site, Postoperative abscesses and Retained sponge.</p>

<p><span style="font-family: Calibri;"><span style="color: #000000;">You might have a good case, but we must do a lot of work before we know. First, we will gather the relevant medical records. In investigating the case, we will gather the facts, information about the injuries, future damages, and the identification of the parties, hospitals, nurses, physicians or other medical providers. We identify the venue and the statute of limitations which applies.</span></span></p>
<p><span style="color: #000000; font-family: Calibri;">We will often after the initial review of the medical records locate a medical expert to review the records before instigating litigation.&nbsp; Establishing that the care was “below the standard of care” or what other reasonably prudent physicians would do under similar conditions requires expert testimony usually. This violation of a standard of care is often called Negligence or Malpractice. We must also show whatever the medical provider did wrong cause the harm to the patient. The causation is often the problem, there can be other causes, and this one must be substantial. </span></p>

Even if the doctor fell beneath the standard of care, the patient can’t sue for malpractice if the patient suffered no identifiable harm. Some harms don’t justify the cost of a lawsuit. You can still report a doctor to a state agency even if you file no lawsuit. (<a href="http://www.ksbha.org/complaints.shtml">Kansas</a>, <a href="https://pr.mo.gov/healingarts.asp">Missouri</a>) Although reporting to a state agency will not result in any compensation it will be important in getting the medical provider to improve their performance and holding them accountable. </span></p>
<p><span style="color: #000000; font-family: Calibri;">In evaluating the case, you must consider how many experts will be needed and evaluate the cost in light of the amount of the potential recovery. These cases are expensive particularly if there are multiple experts needed. </span></p>

There have been some studies that showed the greatest benefit is to use the procedures with three hours after stroke onset. The medical providers must meet the standard of care to prevent and treat pressure sores and to provide the appropriate levels of hydration and nutrition. Your family member may have a claim if the treatment plan is not updated after a bed sore <span style="font-family: Arial;">is discovered</span> or if the patient is losing weight significantly. These patients require supervision and assistance with daily living activities.<span style="font-family: Arial;">  </span>If this level of care is foreseeable and not provided, it can result in a legal claim for damages. Frequent turning and pressure relieving devices can prevent pressure sores. Once the sore develops, <span style="font-family: Arial;">the</span> facility must have a proper care plan and provide proper care and treatment. <p>The first issue in many medical malpractices cases is that of causation. Just because there is an adverse result from a procedure does not mean in a court of law that the Judge will assume that the bad result came from malpractice. The plaintiff must have sufficient evidence regarding causation to avoid summary judgment. If there is no evidence of causation, the defendant can move to have the case dismissed. <p>Unless the negligence is so apparent that a layperson can understand it, we must have expert testimony on the standard of care and the cause of the injury. An expert must testify based on what is probably true not what is possible. So an expert would be asked if he or she has an opinion on whether or not there were any departures from the approved standard medical care that caused the injuries. The answer must be based on a reasonable medical probability, not just a mere possibility.</p>
