One man got more than he expected in sitting down to a Royal’s baseball game. During and inter-inning promotion Royal’s mascot “Sluggerrr” threw a foil wrapped hot dog into the crowd. Unfortunately for the man attending the game, he caught the edible projectile with his eye causing a detached retina and a traumatic cataract. The man sued for these injuries that he sustained. The jury originally found that the Plaintiff, the man suing “Sluggerrr”, to be 100% at fault, however after a series of appeals it made its way before the Missouri Supreme Court. The Court held it was an error, vacated the judgement, and remanded the case be retried on negligence and comparative fault. This means that the court will have to decide who is responsible for the incident by comparing percentage fault of all parties.
